6th DCA issues decision in State v. Riley
Last week, the Sixth District issued a one-sentence decision, granting the State’s petition and quashing the trial court's ruling.
In late May, as TFDP previously covered, the Sixth District Court of Appeal issued its decision in State v. Lobato regarding the application of Florida’s 2023 capital sentencing statute to Lobato’s trial under the ex post facto clauses of the U.S. and Florida Constitutions.
Last week, the Sixth District issued its decision in State v. Riley, which was another case out of Polk County that presented a similar issue. In a one-sentence decision, the Court granted the State’s petition for writ of certiorari and quashed the trial court’s decision based on the Court’s reasoning in Lobato.
Again, Judge White dissented, referencing his dissenting opinion in Lobato.
