Gaskin Warrant: Preparing for Warrant Litigation
Shortly after Gov. DeSantis issued the warrant scheduling Gaskin’s execution for April 12, 2023, the Supreme Court of Florida issued a scheduling order for litigation related to the execution.
The warrant issued on Monday afternoon scheduling his execution comes two days after Gaskin’s 56th birthday. He was born on March 11, 1967.
Shortly after Governor DeSantis issued the warrant scheduling Gaskin’s execution for April 12, 2023, the Supreme Court of Florida issued a scheduling order.
Between now and the day of execution—unless a stay is granted in the meantime—Gaskin’s attorney's will hardly sleep. They will work around the clock in an effort to save their client from execution.
The first step will be filing a motion in the circuit court (Flagler County) seeking relief. The circuit court will determine whether an evidentiary hearing is appropriate and will ultimately issue a ruling on the motion. The circuit court has until 3:00 p.m., Wednesday, March 22, 2023, to rule on the motion.
Any appeal from that ruling will go straight to the Supreme Court of Florida. The Court has already set the briefing schedule:
