GUDINAS WARRANT: Circuit court denies evidentiary hearing

Thomas Gudinas’s execution is scheduled for June 24 at 6:00 p.m. His successive motion for postconviction relief is currently pending in the circuit court. As TFDP previously covered, Gudinas requested an evidentiary hearing on his claim that his lifelong mental illnesses make him ineligible for execution under the Eighth Amendment to the U.S. Constitution.
The docket reflects that, on Monday, the circuit court denied Gudinas’s request for an evidentiary hearing.

On Tuesday, Gudinas’s attorneys filed written closing arguments on Gudinas’s motion. A copy can be downloaded here. The State declined to file a written closing argument.
TFDP was able to access the Scheduling Order for the circuit court proceedings. According to the Scheduling Order, the circuit court will issue its final Order on Gudinas’s claims by tomorrow, June 5, at 2:00 p.m.
