New Federal Claim
Late yesterday, Hutchinson filed a new federal claim and an emergency motion for stay of execution.
Hutchinson filed a petition for writ of habeas corpus seeking relief under the Eighth Amendment. The petition begins: “Jeffrey Glenn Hutchinson is scheduled to die in just hours, but has no rational understanding of why.” The petition argues that the state court proceedings were inadequate to sufficiently review and determine whether Hutchinson is competent for execution.
The motion states that Hutchinson’s federal claim “was filed hours after the Florida Supreme Court upheld, just before 6:00 p.m. on April 30, 2025, the denial of relief on the competency issue.” The motion asks the Court to stay the execution, which “is now mere hours away,” to allow for “meaningful review of his competency claim in federal court.”

I am against any executions.
Any chance of a stay of execution pending resolution of outstanding court issues? Should be.
