Supreme Court of Florida OA Delayed - Leon Davis, Jr.
Oral argument scheduled for this week in Leon Davis, Jr.'s postconviction appeal has been delayed.
The Florida Supreme Court’s oral arguments for this month were yesterday and today. One death penalty case was on the schedule—Leon Davis, Jr.’s appeal from the circuit court’s denial of his claims for postconviction relief under Florida Rule of Criminal Procedure 3.851.
However, on Monday morning, the Attorney for the State filed a last-minute emergency request to continue the oral arguments due to a family emergency. The motion was unopposed.
On Tuesday, the Court entered an Order granting the motion and removing the case from the schedule.
The OA has not been rescheduled at this time.
At issue in the case are Davis’s several claims that his trial counsel was ineffective, that the cumulative error deprived him of a fundamentally fair trial, and a claim related to his competency.
