WAINWRIGHT WARRANT: Evidentiary hearing denied
Anthony Wainwright’s execution is scheduled for June 10 at 6:00 p.m. Yesterday afternoon, the circuit court denied Wainwright’s request for an evidentiary hearing on his claims.
Anthony Wainwright’s execution is scheduled for June 10 at 6:00 p.m. Yesterday afternoon, after a Huff hearing, the circuit court denied Wainwright’s request for an evidentiary hearing on his claims.
On Thursday, there was litigation related to substitution of Wainwright’s counsel. Ultimately, the Court granted the request in part, allowing Wainwright’s pro bono counsel to serve as co-counsel with his existing counsel.
Also on Thursday, Wainwright, through his attorneys, filed an Amended Eighth Successive Motion for Postconviction Relief. On Friday, the State filed an Answer to the Amended Motion.
On Friday, the circuit court held a Huff hearing on the Amended Motion to determine whether an evidentiary hearing is required on Wainwright’s claims.
On Friday afternoon, the circuit court entered an Order determining an evidentiary hearing is not required. The Court’s Order determines that Wainwright has not “raise[d] a claim that requires a determination of material fact, and that an evidentiary hearing is not required.” The Court’s ruling on Wainwright’s Amended Motion is due Tuesday at noon.

Following this ruling, the Court vacated its prior Order directing that Wainwright be transported for an evidentiary hearing, which is now unnecessary.
