Johnson v. State (corrected opinion)
As TFDP previously covered here, the Florida Supreme Court affirmed Johnson’s death sentence on July 11, 2024. This week, the Court issued a corrected opinion making one minor edit:
Stein v. State
The Court also issued its opinion in Stein v. State. In a unanimous per curiam opinion, the Court affirmed the circuit court’s summary denial of Stein’s third successive motion for postconviction relief.
Stein was sentenced to death in 1991. His sentence became final in 1994.
In the postconviction motion at issue, Stein raised a Brady claim alleging that the State did not tell the defense about a trial witness’s expectation of a deal for her testimony. Stein also argued that the deal constitutes newly discovered evidence. The Supreme Court affirmed the circuit court’s denial of both claims.
