Gadsden County: Marvin Cannon resentenced to LWOP
Marvin Cannon has been resentenced to life without parole (LWOP). It appears the State agreed to drop the death penalty on resentencing.
Marvin Cannon was convicted of first-degree murder and other crimes for crimes that occurred in 2004. He was sentenced to death based on the jury’s recommendation for death by a vote of 9-3.1 After Hurst, Cannon was given a new penalty phase.2
According to a Memo from the Department of Corrections (DOC) on Friday (and posted by Robert Dunham (Death Penalty Policy Project) over the weekend), Cannon has been resentenced to life.
The trial court entered the new sentence of life in prison without parole (LWOP) on October 31. It appears the State agreed to drop the death penalty on resentencing.
As of this morning, Cannon is still listed on DOC’s death row list, but will likely be removed soon.
