Lake County: Donte Hall resentenced to LWOP
On November 12, Hall was resentenced to life in prison without parole after the State dropped the death penalty.
Donte Hall was originally sentenced to death for crimes that occurred in 2006 following a jury’s recommendation for death by a vote of 8-4. The jury found three aggravating factors unanimously and the fourth by a vote of 11-1.1
On direct appeal in 2012, the Florida Supreme Court affirmed Hall’s conviction and sentence of death. In 2017, after Hurst, Hall received a new penalty phase.2
While his new sentencing was pending, Hall’s attorneys argued that Hall is intellectually disabled and, therefore, ineligible for the death penalty. There was also evidence of intellectual disability presented at Hall’s original trial.3
On November 12, the docket reflects the State agreed to drop the death penalty, and Hall was resentenced to life in prison without parole (LWOP).
