Isn't Sumner v. Shuman, 483 US 66 (1987), a more significant issue than Hurst? Sumner prohibits mandatory death sentences without an opportunity to present mitigation.
Furman also made clear that mandatory death sentences are unconstitutional. I agree this is an issue, as I mentioned in a prior post. The discussion focused on Hurst and the sentencing procedure, which is why I chimed in on that.
