Glen Rogers’ execution is set for May 15 at 6:00 p.m. On Thursday, as TFDP covered, the Florida Supreme Court denied Rogers' pending appeal.
On Friday, Rogers filed a petition for writ of certiorari at the U.S. Supreme Court seeking review of the Florida Supreme Court’s decision. He also filed an application for stay of execution.
Rogers’ petition relates to his claim that Florida’s lethal injection protocol will cause him undue pain due to his Porphyria. The petition presents the following questions:

It is indisputable that Rogers will be irreparably harmed if his execution is allowed to go forward, and the balance of equities weighs heavily in favor of a stay. Florida’s interest in the timely enforcement of judgments handed down by its courts must be weighed against Rogers’s continued interest in his life.
