Scheduling Order
On Monday morning at 9:00 a.m., the Court held a case management conference. Also that day, the State filed a motion asking the Court to enter a scheduling order, as it has in the other warrant-related cases this year.
After the case management conference, the Court entered a Scheduling Order setting forth the following schedule for circuit court proceedings related to Wainwright’s scheduled execution:
May 13 at 3:00 p.m.: FDOC to provide updated inmate records to Wainwright’s counsel
May 13 at 3:00 p.m.: Wainwright to file additional public records demands
May 14 at 10:00 a.m.: objections to public records requests due
May 14 at 3:00 p.m.: hearing on public records requests
May 14 at 5:00 p.m.: ruling on public records requests
May 15 at 11:00 p.m.: Wainwright’s postconviction motion due
May 16 at 10:00 a.m.: State’s answer to Wainwright’s motion due
May 16 at 1:00 p.m.: Huff hearing
May 16 at 5:00 p.m.: ruling on Huff hearing
May 19 at 9:00 a.m.: evidentiary hearing, if necessary1
May 20 at noon: ruling on Wainwright’s postconviction motion
Postconviction Motion
Ahead of schedule, Wainwright, through his attorney, filed a successive motion for postconviction relief just before noon today. In the motion, Wainwright raises the following claim:
