Zack Warrant: Appeal from federal court's denial of stay
Zack has appealed the federal district court’s denial of his Motion for a Stay of Execution.
Michael Zack’s execution is scheduled for October 3 at 6:00 p.m. It is the sixth scheduled execution in the State of Florida this year.
Zack currently has claims pending in both the federal and state courts in Florida. Briefing is completed in the Florida Supreme Court, but the timing of the Court’s ruling is unclear. Late last week, the U.S. District Court for the Northern District of Florida denied his Motion for a Stay of Execution. (More on that here.)
Yesterday (Sept. 17), Zack filed a Notice of Appeal of the district court’s denial of his Motion for a Stay of Execution.
The Notice of Appeal was transmitted to the U.S. Circuit Court of Appeals for the Eleventh Circuit today.
Now cases are pending in three courts:
Florida Supreme Court;
U.S. District Court for the Northern District of Florida; and
U.S. Circuit Court of Appeals for the Eleventh Circuit.
